This consolidated document governs website use, professional services information, and how we process personal data in accordance with Malaysian law. A Bahasa Malaysia version will be made available; where there is any inconsistency, the English version prevails.

Part A: Terms of Use

1. Who we are

Saifudin & Co. ("SNCO", "we", "us" or "our") is a firm of Chartered Accountants in public practice in Malaysia. Our office is at B-11-5, Plaza Mont Kiara 2, Jalan Kiara, Mont Kiara, 50480 Kuala Lumpur, Malaysia.

2. Acceptance of terms

By using www.saifudinco.com (the "Site") or contacting us through the Site, you agree to these Terms and this Policy. If you do not agree, please do not use the Site.

3. Website content and no advice

The Site provides general information only. It does not constitute accounting, audit, tax, legal or other professional advice, and should not be relied upon as such. Any engagement for professional services will be governed by a separate written engagement letter.

4. Permitted use and acceptable conduct

You may use the Site for lawful, personal and internal business purposes only. You must not:

  • copy, distribute or modify any part of the Site without prior written consent;
  • attempt to gain unauthorised access to the Site, servers or networks; or
  • introduce viruses or other harmful material.

5. Intellectual property

All content on the Site, including text, graphics, logos and software, is owned by SNCO or our licensors and is protected by law. You may download or print a reasonable number of pages for personal reference only; all other use requires our prior written consent.

6. Third-party links

The Site may link to third-party websites or tools (e.g., analytics, embedded forms). We are not responsible for their content, privacy practices or availability.

7. Disclaimers

The Site is provided on an "as is" and "as available" basis. We do not warrant that it will be uninterrupted or error-free.

8. Liability cap (website use)

To the maximum extent permitted by Malaysian law, we exclude all implied warranties and will not be liable for any indirect, incidental or consequential loss arising from your use of the Site. We do not exclude or limit liability to the extent it would be unlawful to do so, including for fraud or wilful misconduct. Nothing in these Terms limits your non-excludable statutory rights.

Note on professional services: Any limitation of liability for paid professional services will appear in the relevant engagement letter and may include a monetary cap (for example, a multiple of the fees paid). Such caps do not affect liabilities that cannot be limited under Malaysian law.

9. Time limits for claims

Any claim relating to the Site must be commenced within the statutory limitation periods under Malaysian law.

10. Suspension and changes

We may suspend or change the Site at any time. We may amend these Terms; the “Last updated” date will change accordingly.

11. Governing law and jurisdiction

These Terms are governed by the laws of Malaysia. The Malaysian courts have exclusive jurisdiction to settle any dispute arising out of or in connection with the Site.

12. Registrations & Credentials

  • Registration: Registered with Suruhanjaya Syarikat Malaysia (SSM) under the Registration of Businesses Act 1956
  • Professional: Active member of the Malaysian Institute of Accountants (MIA) with valid practising certificate
  • Audit Licences: Companies (Companies Act 2016) and Co-operative Societies (Co-operative Societies Act 1993)
  • Tax Registration: Licensed tax agent with LHDNM (Income Tax Act 1967)
  • Insurance: Professional indemnity insurance maintained in line with MIA requirements
  • Verification: See MIA Member Directory, SSM e-Info, or LHDN directories

13. Services

  • Accounting & Bookkeeping: Financial statements, management accounts, bookkeeping setup, controls, compliance reporting
  • Audit & Assurance: Statutory audits (companies & co-ops), internal audits, due diligence, special reviews
  • Taxation: Corporate & personal tax compliance, SST/GST advisory, planning, transfer pricing, representation before LHDNM
  • Corporate Recovery & Advisory: Liquidations, restructuring, receivership, valuations, financial forecasts, corporate finance

14. Service Standards

All services comply with MIA By-Laws, Malaysian Financial Reporting Standards (MFRS), Malaysian Approved Standards on Auditing (MASA/ISA), and Malaysian Standards on Quality Management (MSQM). We commit to competent, compliant, confidential, timely and professional service.

15. Fees & Payments

  • Fees are based on time, complexity and expertise; estimates are provided in engagement letters
  • Government/third-party disbursements are itemised separately
  • Standard payment terms: 30 days from invoice unless agreed otherwise
  • Interest may apply to overdue amounts; prepayment may be required for long-term engagements

16. Consumer Rights & Complaints

  • Your rights: Clear information, transparent pricing, access to your records, explanation of recommendations
  • Quality: Competence, due care, compliance, confidentiality, timely completion
  • Complaints: Contact your engagement partner or email complaints@saifudinco.com. We respond within 14 working days; unresolved matters may be escalated to the Managing Partner.
  • External channels: MIA (professional conduct), Tribunal for Consumer Claims (claims ≤ RM50,000), Ministry of Domestic Trade & Cost of Living, or civil courts

17. Cancellation, Refunds & Liability

  • Clients may terminate with 30 days’ notice; immediate termination if professional standards are breached
  • Refunds: pro-rata for unused prepaid services; completed work must be paid; refunds processed within 14 working days
  • Liability is covered by professional indemnity insurance and limited to direct losses caused by negligence, subject to Malaysian law; consequential losses are excluded unless agreed

18. Compliance

We comply with the Consumer Protection Act 1999, Companies Act 2016, Income Tax Act 1967, PDPA 2010, AMLATFPUAA 2001, and MIA By-Laws. We conduct KYC/AML checks (identity verification, beneficial ownership, source of funds) and report suspicious transactions to regulators as required.

  • Use of AI Tools: We may use secure artificial intelligence (AI) technologies, including large language models (LLMs), to assist in drafting, analysis, and support functions in our professional work processes. Such use is always supervised by qualified professionals and does not replace professional judgment. Personal and client information processed through AI tools is handled in accordance with the PDPA 2010, our confidentiality obligations, and subject to appropriate contractual and technical safeguards. By engaging our services, you consent to such use. If you prefer that your data is not processed through AI tools, please notify us and we will accommodate your request.

22. Sharing

We share data only with service providers, advisers, regulators/authorities, and within professional networks subject to safeguards. We do not sell data.

23. Security & retention

We apply organisational/technical safeguards, training and monitoring. Records are kept for at least 7 years (or longer where law requires); website data 12–24 months.

24. International transfers

Transfers abroad (e.g., cloud) are made only with legal bases and safeguards as required under Malaysian law.

25. Your rights

Access, correction, deletion (where lawful), objection to processing, withdraw consent, and portability where applicable. Requests: privacy@saifudinco.com.

26. Children

We do not knowingly collect data from children under 18.

27. Data breaches

We will assess and notify the Commissioner/affected individuals where required.
